Agreement between You and the MSP group, consisting of the corporations MSP Musique Inc., MSP Levis Inc., and MSP Web Inc.
By Browse and using this website, you acknowledge the terms that govern it as well as those applicable to all transactions. You acknowledge that you have read and fully understood these terms.
This document also applies to any transaction made in-store, by telephone, or in any other manner with the MSP group.
The conditions described in this text constitute a contract between you and the MSP group, and you acknowledge that you are bound by them.
MSP Web Inc., MSP Musique Inc., and MSP Levis Inc. reserve the right to modify any condition without prior notice.
It is the customer's responsibility to consult this document for each transaction.
The MSP group makes these conditions available at all times on its website. No other request for publication will be necessary.
You must be 18 years of age or older.
The following text refers to MSP Web Inc., MSP Musique Inc., and MSP Levis Inc. as "The Seller".
The following text refers to any person using this site as "The Customer".
The Seller's place of business is at 9-140 Marie Victorin, Levis, G7A 2T2.
The Customer and the Seller will comply with the laws in effect in the Seller's province.
The Seller only conducts business in Canada. Any customer using the site from another country where laws and conditions may be different does so at their sole discretion and without the consent of the Seller.
It is forbidden to copy or reproduce any part of this site without permission from the Seller.
For a transaction delivered to the customer, payment can be made via Stripe.
For any in-store transaction, payment can be made by cash, debit, Visa, or Mastercard.
For payment by check, the goods will only be released to the customer after the funds have been cleared by the financial institution.
The customer can only take possession of their goods upon full and final payment.
All or parts of an item's description originate from the item's manufacturer. The information on the Seller's website is for informational purposes only, and the Seller does not guarantee its accuracy, correctness, or relevance.
The Seller does not guarantee the availability of items online. It is the Customer's responsibility to validate the accuracy of the desired item's features, as well as its availability and delivery times.
In case of a discrepancy in a product's characteristics, including quantity, color, size, price, etc., the information in-store will be considered correct.
The Customer acknowledges that the Seller cannot be held responsible for any error in the description, information, price, or quantity of an item, within the limits of the legislation of the province of Quebec.
The Seller reserves the right to refuse any order.
Goods are provided "as is," without further obligation from the Seller.
The Seller provides no warranty other than that described by the manufacturers.
Furthermore, the Seller makes no representations regarding the quality, accuracy, reliability, or use of the products and therefore cannot be held responsible for them.
Although the Seller works to ensure the accuracy of item descriptions, prices, inventory, and descriptions on the website, the Seller cannot be held responsible for any error resulting from the use of the site or a product. It remains the Customer's responsibility to verify the specific conditions before each transaction.
In no event shall MSP Web Inc., MSP Musique Inc., MSP Levis Inc., its officers, or employees be held liable for any failure by the customer, any ignorance of the terms of sale described herein, the use of the equipment, its performance, a warranty issue, or differences from the customer's expectations.
It is the Customer's responsibility to read these conditions carefully for each transaction.
The item price is in Canadian dollars.
The item price always excludes taxes.
The item price always excludes shipping fees.
Insurance fees are extra.
Per section 1.5.3, the in-store price is considered correct.
Prices are valid for in-stock items only.
Discounts cannot be combined, and clearance items are not eligible for free shipping or other promotions.
Any product on order or out of stock may be billed at a different price if the manufacturer, exchange rate, or any other reason causes the price to vary between the time of order and delivery.
Per sections 2.1.5 and 2.1.8, the Seller reserves the right to modify any invoice in accordance with the terms of sale.
The Seller does not commit at any time to changing its pricing policy.
Unless otherwise indicated, all items are new and covered by the manufacturer's warranty for all Canadian customers.
The Seller reserves the right, for any item, to sell a floor demonstrator without any other notice or discount.
All discounted items are automatically considered demonstrators. They may have scratches or be missing accessories and documents.
In no event is the Seller obligated to provide an item's original box or a physical copy of the user manual.
A French manual can be obtained only if the manufacturer produces one.
The Seller reserves the right to open any box to inspect the equipment before its delivery.
As the equipment may differ from the description, it is the Customer's responsibility to ensure that the chosen item corresponds to their expectations in terms of physical appearance, features, and performance. See 2.6.
The Seller disclaims all liability for any problem due to confusion or failure in the choice of an item by the Customer. It is the Customer's responsibility to correctly identify the item they desire. See 2.6.
The Seller reserves a period of 5 business days to process your order.
Any equipment not in stock may be sent to you within a 60-day period.
Per section 2.3.2, in the event of a delivery delay, no compensation will be due to customers.
After 60 days, the Seller may refund the customer, unless they notify the customer by email of the delivery delay for the backordered product.
In no event can a stock outage affect the terms of sale or generate compensation. The Seller does not guarantee the inventory of manufacturers.
In no event shall the Seller be held responsible for delays or errors by the carrier.
The Seller cannot be held responsible for any loss of profit, performance, or enjoyment due to an out-of-stock item.
The Seller reserves the right to change or modify the price and description of any item without any other notice.
Photos are for illustrative purposes only.
It is the customer's responsibility to verify the color, size, dimensions, or any other characteristics to correctly identify a chosen item. In case of error, the Seller reserves the right to exchange the item or not. All related costs will be borne by the customer.
The warranty for a purchased item is that of the item's manufacturer.
Warranties only cover manufacturing defects, and only the manufacturer can determine if a breakage is covered by the warranty.
It is the customer's responsibility to check the warranty conditions with the manufacturer.
The Seller cannot be held responsible for any costs related to a problem, a warranty claim, or a warranty denial by the manufacturer.
The Seller may, at its discretion, act as an intermediary between the customer and the manufacturer.
All costs related to a warranty claim are the responsibility of the customer.
Shipping fees are the responsibility of the customer.
Shipping costs are estimated for the Quebec-Montreal corridor. The Seller reserves the right to modify shipping costs for all other delivery areas.
The Seller is not obligated to refund the customer if shipping costs are higher depending on the package's destination.
The Seller may, at its discretion, provide an estimate of insurance costs for a package, which does not affect its liability.
Even in the case of a promotion with free shipping, the shipping cost is considered part of the item's price and may be separated from it.
Under no circumstances can costs related to shipping be credited. The customer is solely responsible for all shipping fees.
For any return, shipping fees are the responsibility of the customer.
Shipping insurance can be purchased for any item.
Insurance fees are in addition to shipping fees.
By refusing, ignoring, or omitting to take out insurance, the customer becomes solely and entirely responsible for any damage, breakage, or loss of their purchase.
The customer acknowledges that the Seller has no other obligation to suggest or remind them to take out insurance.
The Seller disclaims all liability regarding shipping insurance and reserves the right to act or not as an intermediary between the carrier and the customer.
All sales are final.
No refunds.
The Seller reserves the right, at its sole discretion, to replace an item or issue a credit for it.
Under no circumstances can shipping or insurance fees be credited.
A claim must be made within 5 business days of receiving the merchandise. No returns will be accepted after one week from the delivery date.
At all times, the Seller reserves the right to deduct a restocking fee of 25% or less at its discretion.
Any merchandise returned and damaged by the customer or the carrier will be refused.
No returns can be made on wearable items, hygiene products, or products with copyrights, such as harmonicas, strings, software, etc.
Any defective item must be reported to the Seller immediately.
The customer must contact the Seller as soon as possible to report a malfunction.
It is at the Seller's discretion to provide support or the manufacturer's contact information when a technical problem is reported.
All shipping fees are the responsibility of the customer, even for a warranty claim.
The item must be returned complete, along with the original manuals and boxes when provided by the Seller. Any missing or damaged accessories or packaging may reduce or void the credit granted by the Seller.
No returns can be made on special orders made for the customer.
No returns can be made on an item personalized for a customer.
