Terms and conditions
1.0 General terms and conditions
1.1.1 Agreement between You and The MSP Group, consisting of the corporations MSP Musique Inc., MSP Levis Inc. and MSP Web Inc.
1.1.2 By browsing and using this site, you acknowledge the rules that govern it as well as those applicable to all transactions. You acknowledge that you have read these rules and are fully aware of them.
1.1.3 This document also applies to all in-branch, over-the-phone or any other type of transaction with the MSP Group.
1.1.4 The conditions described in this text constitute a contract between you and the MSP Group and you acknowledge that you are bound by them.
1.1.5 Msp Web Inc, Msp Musique Inc, Msp Levis Inc, reserve the right to change any of the terms and conditions without prior notice.
1.1.6 It is the customer’s responsibility to consult this document before each transaction.
1.1.7 The MSP Group makes these conditions accessible at all times on its website. No further request for publication will be necessary.
1.1.8 You must be at least 18 years of age.
1.2 Legal Provisions
1.2.1 The following text refers to Msp Web Inc, Msp Musique Inc and Msp Levis Inc, as; The Seller.
1.2.2 The following text refers to any person using this site as; The Customer.
1.2.3 The Seller has its place of business at 9-140 Marie Victorin Levis, G7A 2T2.
1.2.4 The Customer and The Seller shall comply with the laws in force in the province of The Seller.
1.2.5 The Seller only does business in Canada. Any Customer using the site in another country where the laws and conditions may be affected or different, does so at its sole discretion and without further consent of The Seller.
1.3 It is forbidden to copy or reproduce any part of this site without permission from The Seller.
1.4 Payment
1.4.1 For transactions delivered to The Customer’s premises, payment may be made using Stripe.
1.4.2 For in-store transactions, payment may be made by cash, direct payment, Visa or Mastercard.
1.4.3 For payment by cheque, the material will only be delivered to The Customer once the funds have been cleared by the financial institution.
1.4.4 The Customer may only take possession of the equipment upon full and final payment.
1.5 Accuracy
1.5.1 All or part of the description of an item comes from the manufacturer of that item. The information on The Seller’s site is for information purposes only and The Seller does not guarantee its accuracy, correctness or relevance.
1.5.2 The Seller does not guarantee the availability of material online. It is The Customer’s responsibility to validate the accuracy of the characteristics of the item desired, as well as its availability and delivery times.
1.5.3 In the event of a difference in the characteristics of a product, including quantity, color, size, price, etc., the in-branch information will be considered accurate.
1.5.4 The Customer acknowledges that The Seller cannot be held responsible for any error in the description, information, price or quantity of an item; and this to the extent permitted by the laws of the Province of Quebec.
1.5.5 The Seller reserves the right to refuse any order.
1.6 Liability
1.6.1 The goods are supplied as is, without any further obligation on the part of The Seller.
1.6.2 The Seller provides no warranty other than that described by the manufacturers.
1.6.3 Furthermore, The Seller makes no claims as to the quality, accuracy, reliability or use of the products and therefore cannot be held liable.
1.6.4 Although The Seller works to ensure the accuracy of item descriptions, prices, inventory and descriptions on the Website, The Seller cannot be held responsible for any errors resulting from the use of the Website and a product. It remains The Customer’s responsibility to review the specific terms and conditions prior to each transaction.
1.6.5 In no event shall MSP Web Inc, MSP Musique Inc, MSP Levis Inc, its managers or employees be held responsible for any failure by The Customer, ignorance of the sales conditions described in this text, the use of the material, its performance, a warranty problem or differences in relation to The Customer’s expectations.
1.6.6 It is The Customer’s responsibility to read these conditions carefully at the time of each transaction.
2.0 Prices and items
2.1 Item price
2.1.1 The item price is in Canadian dollars.
2.1.2 The item price always excludes taxes.
2.1.3 The item price always excludes shipping costs.
2.1.4 Insurance costs are extra.
2.1.5 Being 1.5.3 the in-store price is considered accurate.
2.1.6 Prices are applicable to in-stock items only.
2.1.7 Discounts are not stackable and clearance items are not eligible for free shipping or other promotions.
2.1.8 Any product on order or out of stock may be invoiced at a different price if the manufacturer, exchange rate or any other reason causes the price to vary between the time of order and the time of delivery.
2.1.9 Being 2.1.5 and 2.1.8, The Seller reserves the right to modify any invoice in accordance with the conditions of sale.
2.1.10 The Seller does not commit itself at any time to modify its pricing policy.
2.2 Condition of item
2.2.1 Unless otherwise specified, all items are new and guaranteed by the manufacturer to all Canadian customers.
2.2.2 The Seller reserves the right, for any item, to sell a floor demo without further notice or discount.
2.2.3 All discounted items are automatically considered demonstrators. They may be scratched or missing accessories and documents.
2.2.4 At no time is The Seller obligated to provide the original box for an item or a physical copy of the user’s manual.
2.2.5 A french manual can only be obtained if the manufacturer produces a version.
2.2.6 The Seller reserves the right to open any box for inspection prior to delivery.
2.2.7 As the equipment may differ from the description, it is The Customer’s responsibility to ensure that the item chosen corresponds to his expectations, both physically and in terms of its characteristics and performance. See 2.6
2.2.8 The Seller is not responsible for any problem caused by confusion or failure in the selection of an item by The Customer. It is The Customer’s responsibility to properly identify the item he/she desires. See 2.6
2.3 Delivery times
2.3.1 The Seller reserves 5 working days to process your order.
2.3.2 Any material not in stock can be shipped within 60 days.
2.3.3 Being 2.3.2, in the event of a delay in delivery, no compensation will be paid to customers.
2.3.4 After 60 days, The Seller may refund the customer, unless the customer is notified by e-mail of the delay in delivery of the out-of-stock product.
2.3.5 Under no circumstances may an out-of-stock condition affect the terms of sale or generate compensation. The Seller does not guarantee the manufacturer’s inventory.
2.3.6 Under no circumstances can The Seller be held responsible for carrier delays or errors.
2.3.7 The Seller cannot be held responsible for any loss of profit, performance or enjoyment due to an item being out of stock.
2.4 The Seller reserves the right to change, modify the price and description of any item without prior notice.
2.5 Photos are for reference only.
2.6 It is The Customer’s responsibility to ensure that the color, size and other characteristics of the item are correct. In case of error, The Seller reserves the right to exchange or not the item. All related costs will be charged to The Customer.
3.0 Warranty
3.1 The warranty on a purchased item is that of the manufacturer of that item.
3.2 Warranties cover manufacturing defects only, and only the manufacturer can determine whether a defect is covered by warranty or not.
3.3 It is The Customer’s responsibility to verify warranty conditions with the manufacturer.
3.4 The Seller shall not be held responsible for any costs incurred as a result of a problem, warranty claim or refusal of warranty by the manufacturer.
3.5 The Seller may, at its discretion, act as an intermediary between the Customer and the manufacturer.
3.6 All costs associated with a warranty claim are the responsibility of The Customer.
4.0 Transport and insurance
4.1 Transport costs are at The Customer’s expense.
4.2 Transportation estimates
4.2.1 Transport costs are estimated for the Quebec-Montreal corridor. The Seller reserves the right to modify transportation costs for all other delivery areas.
4.2.2 The Seller is not obliged to reimburse The Customer if the transportation costs are higher depending on the destination of the package.
4.2.3 The Seller may, at its discretion, provide an estimate of the cost of insuring a parcel, which does not affect its liability.
4.3 Even in the case of a promotion with free transport, the cost of transport is considered part of the price of the item and may be dissociated from it.
4.4 At no time can transportation costs be credited. The Customer is solely responsible for all transportation costs.
4.5 For all returns, transportation costs are at the customer’s expense.
4.6 Transport insurance
4.6.1 Transport insurance may be taken out on the purchase of any item.
4.6.2 Insurance charges are in addition to transportation charges.
4.6.3 By refusing, ignoring or omitting to take out insurance, The Customer is solely and entirely responsible for any damage, breakage or loss of his purchase.
4.6.4 The Customer acknowledges that The Seller has no other obligation to suggest or remind The Customer to take out insurance.
4.6.5 The Seller disclaims all liability for transport insurance and reserves the right to act or not to act as intermediary between the carrier and The Customer.
5.0 Returns and exchanges
5.1 Sales conditions
5.1.1 All sales are final.
5.1.2 No refunds.
5.1.3 The Seller reserves the right at its sole discretion to replace an item, or to credit it.
5.1.4 At no time may shipping or insurance charges be credited.
5.1.5 A claim must be made within 5 working days of receipt of merchandise; no returns will be accepted after one week from the date of delivery.
5.1.6 At all times, The Seller reserves the right to deduct a restocking fee of 25% or less at its discretion.
5.1.7 Any merchandise returned damaged by the customer or the carrier will be refused.
5.1.8 No returns will be accepted on products subject to wear, hygiene or copyright, such as harmonicas, strings, software, etc…
5.2 Return conditions
5.2.1 Any defective item must be reported immediately to The Seller.
5.2.2 The Customer must contact The Seller as soon as possible to report a malfunction.
5.2.3 It is at The Seller’s discretion to provide support or the manufacturer’s contact information when reporting a technical problem.
5.2.4 All shipping costs are the responsibility of The Customer, even for warranty claims.
5.2.5 The item must be returned complete, including manuals and original boxes when supplied by The Seller. Any missing or damaged accessories or packaging may reduce or cancel the credit granted by The Seller.
5.2.6 No returns can be made on orders specially made for The Customer.
5.2.7 No returns may be made on items identified to a customer.
